Terms and Conditions

These Terms govern your booking and participation in any charter operated by Big Coast Marine Adventures ("we", "us") with Captain Pat aboard Sunny Adventures, departing from Denman Island, British Columbia, Canada. By booking a trip, you agree to be bound by these Terms.

2. Auto-Charge Authorization (Optional)

Auto-charge is the default and recommended way to pay your balance, but it is optional. You can opt out at the bottom of the booking form by unchecking the auto-charge consent box — in that case your card will not be saved and you must pay the balance manually before your trip (cash, e-transfer, or card on arrival). The same cancellation policy in Section 3 applies either way.

If you opted out of auto-charge: we will not store your card. You will receive reminder emails approximately 7 days and 48 hours before your trip with a link to pay your balance online if you change your mind, or you can pay Captain Pat directly by cash, e-transfer (pat@bigcoastmarineadventures.com), or card on arrival. Balance must be settled before your trip departs.

3. Cancellations & Refunds (Customer-Initiated)

If you need to cancel, the refund you receive depends on how far in advance you cancel relative to your trip start time (Pacific Time):

To cancel, log into your account and click "Cancel Booking" on the booking page, or email bigcoastmarineadventures@gmail.com. The cancellation timestamp is the moment we receive your request.

Refunds are processed back to the original card and typically appear within 5–10 business days.

4. Captain-Initiated Cancellations

Captain Pat may cancel or reschedule any trip due to:

In any of these cases, you are entitled to a full refund (deposit + any balance paid or auto-charged) or the option to reschedule to a mutually agreeable date at no extra cost. We do not reimburse separate travel, accommodation, or other costs you may have incurred.

5. Weather Calls

Final weather decisions are typically made the morning of the trip. If conditions are marginal, Captain Pat will contact you to discuss your options before departure. We do not charge for trips that are cancelled by Captain Pat for weather, but we cannot offer refunds if you choose not to depart on a trip that Captain Pat has determined is safe to run.

6. Late Arrival & No-Shows

Please arrive at the dock at least 15 minutes before your scheduled departure. If you are more than 30 minutes late without notice, we may treat the booking as a no-show. Trips do not run longer to make up for late arrivals; the booked duration ends at the scheduled time.

9. Liability & Assumption of Risk

Charter fishing and sightseeing services involve inherent risks, including but not limited to: weather and sea conditions, vessel motion, slips and falls, fishing-tackle injuries, marine wildlife, and exposure to sun and cold. By booking and boarding, you acknowledge these risks and agree that participation is at your own risk.

To the fullest extent permitted by law, Big Coast Marine Adventures, Captain Pat, and the vessel Sunny Adventures shall not be liable for any loss, injury, illness, damage, or death except to the extent caused by our gross negligence or wilful misconduct. You will be asked to sign a standard liability waiver before boarding.

10. Personal Property

You are responsible for your own gear, electronics, and personal belongings. We are not responsible for items lost or damaged on the vessel.

11. Photography & Marketing

Captain Pat may take photos or short videos during trips and use them in marketing materials (website, social media). If you'd prefer not to be featured, please let the Captain know at the start of your trip and we will respect that.

12. Privacy

We collect and process personal information (name, email, phone, payment details) solely to fulfill your booking and send trip-related communications. Card numbers are tokenized and stored only by our PCI-compliant payment processor (Square). See our Privacy Policy for full details.

13. Governing Law

These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable therein. Any dispute arising from these Terms or your booking shall be resolved in the courts of British Columbia.

14. Changes to These Terms

We may update these Terms from time to time. The version in effect at the time of your booking governs that booking. The current version is always available at /terms.
